The terms that govern use of the AlterByte website, project delivery, and subscription services.
These terms cover site use, project delivery, and subscriptions.
Subscriptions use PayFast. Project work is invoiced (often EFT).
"The Architect" helps with scoping only. Validate critical decisions.
About these terms
These Terms of Service ("Terms") govern your use of the AlterByte website, related services, and any client portal features. By accessing or using our website, you agree to these Terms.
Project work is delivered under written statements of work (SOWs), proposals, or subscription plan terms. If a SOW conflicts with these Terms, the SOW will prevail for that project scope.
Who we are
AlterByte operates under the parent company Alter. We are based in South Africa and deliver services remotely.
Website use
You agree not to misuse the website. This includes attempting to gain unauthorized access, interfering with site operations, scraping in a way that impacts service availability, or introducing malicious code.
We may update or remove features at any time. We aim to maintain continuity, but do not guarantee uninterrupted availability.
Accounts & security
- If you create an account, you are responsible for maintaining the confidentiality of your credentials.
- You must notify us promptly if you suspect unauthorized access.
- We may suspend or terminate access where we reasonably believe there is a security risk or breach of these Terms.
Services & delivery
AlterByte delivers digital experience platforms, client systems, and lifecycle assurance/coverage. Delivery details (scope, milestones, timelines, acceptance criteria) are agreed in writing.
You agree to provide timely inputs (content, approvals, access credentials, decision-makers) required to deliver the work. Delays in client inputs may impact timelines.
Payments & subscriptions
Unless agreed otherwise in writing:
- Subscription services are billed via PayFast.
- Project work is billed via invoices and may be payable via EFT/bank transfer.
Cancellations for subscription services take effect at the end of the current billing cycle unless otherwise required by law or stated in the plan terms.
AI assistant disclaimer
Our AI assistant ("The Architect") is provided for general information and scoping support. It is not a legal, financial, or security guarantee. Always validate decisions with a qualified professional where appropriate.
Do not submit sensitive personal information or confidential information in AI prompts.
Intellectual property
Unless otherwise agreed in writing:
- You own your pre-existing materials (logos, brand assets, content) that you provide.
- Project deliverables are licensed or assigned to you as specified in the applicable SOW.
- AlterByte retains rights to its pre-existing tools, frameworks, templates, and general know-how.
Disclaimers & limitation of liability
The website and services are provided "as is" and "as available." To the maximum extent permitted by law, AlterByte disclaims all warranties not expressly stated.
To the extent permitted by law, AlterByte will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill.
Governing law
These Terms are governed by the laws of the Republic of South Africa.
